Terms of Service

1 Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between your school ("School", "you") and the Natija development team ("Natija", "we", "us"). By activating a Natija school account, all staff members (administrators and teachers) who access the platform are bound by these Terms.

If you do not agree to these Terms, you must discontinue use of the Natija platform immediately.

2 Description of Service

Natija provides the following school management services:

• Student registration, class management, and academic session configuration
• Daily attendance tracking with automated parent absence notifications (FCM push + SMS)
• Terminal exam mark entry, NEB 2078 grade calculation, and result ledger generation
• Continuous Assessment System (CAS) management
• PDF generation for report cards, grade ledgers, admit cards, and student ID cards
• IEMIS Excel import and bulk student photo ZIP upload
• School announcement broadcasting and homework assignment management
• Public result portal for students and parents
• Android mobile app for parents and teachers with FCM push notifications

Services are provided on a per-school subscription basis. Features may vary based on your school's subscription plan.

3 School Responsibilities

Your school is responsible for:

• Account Security: Maintaining the confidentiality of all administrator and teacher login credentials. You must immediately notify Natija if you suspect unauthorized access.
• Accurate Data: Ensuring that all student, staff, and academic data entered into the system is accurate, complete, and up to date.
• Authorized Use: Ensuring that only authorized staff members access the platform and that access is revoked promptly when a staff member leaves your school.
• Parent Consent: Obtaining any necessary consent from parents or guardians for the collection and processing of student data, including photographs and academic records.
• Legal Compliance: Ensuring your use of Natija complies with all applicable laws and regulations of Nepal, including data protection requirements.
• Contact Information: Keeping the school's contact details and administrator email up to date for communication from Natija.

4 Acceptable Use Policy

You agree not to use Natija to:

• Enter false, misleading, or fabricated student data, marks, or attendance records
• Attempt to gain unauthorized access to another school's data or the platform's internal systems
• Share login credentials with unauthorized individuals or allow third parties to access your school's account
• Use automated scripts, bots, or scrapers to extract data from the platform
• Transmit malware, viruses, or any malicious code through the platform
• Use the platform in a manner that could damage, disable, or impair the service
• Circumvent security controls, rate limits, or authentication mechanisms
• Violate any applicable laws or regulations of Nepal

5 Data Ownership & Privacy

Your school owns its data. All student records, exam results, attendance data, and documents created within Natija belong to your school. Natija acts as a data processor on your school's behalf.

We process data only as necessary to provide the Natija service. We do not sell, rent, or share your school's data with third parties except as described in our Privacy Policy (e.g., FCM for push notifications, SMS gateway for absence alerts).

You may request a full export of your school's data at any time by contacting us. Upon account termination, we will retain your data for a reasonable archival period and then securely delete it, unless you request earlier deletion.

6 Service Availability & Uptime

We strive to maintain high availability of the Natija platform. However, we do not guarantee uninterrupted access. Scheduled maintenance, server upgrades, or unforeseen outages may occasionally cause temporary downtime.

The platform includes offline attendance syncing in the Android app, which allows teachers to take attendance without an active internet connection; records sync automatically when connectivity is restored.

We will make reasonable efforts to notify schools of planned maintenance in advance through the school announcement system or email.

7 Intellectual Property

The Natija platform, including its source code, design, user interface, logo, and documentation, is the intellectual property of the Natija development team. All rights are reserved.

Your school's data (student records, marks, photos) remains your school's property. Natija claims no ownership over content created by your school.

You may not copy, modify, reverse-engineer, decompile, or distribute the Natija platform or its components without express written permission.

8 Limitation of Liability

To the maximum extent permitted by applicable law, Natija shall not be liable for:

• Any loss of student data arising from school-side actions, unauthorized access due to shared credentials, or force majeure events
• Inaccuracies in NEB grade calculations arising from incorrect marks entry by school staff
• Delays in SMS or push notification delivery due to third-party provider limitations
• Any indirect, incidental, or consequential damages arising from use or inability to use the service

9 Termination

Either party may terminate the service agreement with reasonable written notice. Natija reserves the right to suspend or terminate your school's account immediately for:

• Violation of these Terms or the Acceptable Use Policy
• Non-payment of subscription fees (if applicable)
• Activity that threatens the security or integrity of the platform

Upon termination, you will retain the right to request a copy of your school's data before final deletion.

10 Modifications to Terms

Natija reserves the right to update these Terms of Service at any time. Material changes will be communicated to school administrators with at least 14 days' notice before taking effect. Continued use of the platform after the effective date constitutes acceptance of the revised Terms.

11 Governing Law

These Terms are governed by and construed in accordance with the laws of Nepal. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Nepal.
